Terms of Service

Aloha Dirt Works is a division (DBA) of SDPP, Inc., a California corporation, operating under CSLB License #1115225 (Class A General Engineering Contractor). By using alohadirtworks.com and engaging us for excavation, hauling, or related services, you agree to these Terms of Service.

1. Scope of Services and License Class

We provide excavation, grading, stump removal, debris and trash hauling, construction debris haul-out, concrete and patio demolition, brush and fence-line clearing, drainage solutions, backyard cleanups, shed and ADU pad preparation, foundation excavation, and material delivery (dirt, sand, gravel, mulch) in San Diego County, California.

Aloha Dirt Works holds a Class A General Engineering Contractor license (CSLB #1115225). Class A authorizes engineering work, including excavation, grading, earthwork, demolition, and incidental hauling. We do not perform tree-service work (which requires CSLB Class D-49), pool construction (C-53), electrical (C-10), plumbing (C-36), or roofing (C-39). The specific scope and price for each job is established in a written or verbal estimate before work begins.

2. Pricing, Payment, and Deposit Cap

  • Flat-rate package prices and hourly rates published on our website and marketing materials are accepted as final unless the actual job differs materially from what was described.
  • We accept card, ACH, Venmo, Zelle, or cash on completion.
California Deposit Cap (Business and Professions Code § 7159.5(a)(3)): For any residential home improvement contract over $500, our down payment is limited by California law to the lesser of $1,000 or 10% of the contract price. We honor this cap on every residential quote. Commercial/contractor-to-contractor work (Path C) is not subject to this cap and is governed by negotiated commercial terms.

2a. Service and Repair Contracts (Under $750)

For residential jobs under $750 that you initiate by contacting us, we may offer a Service and Repair Contract under California Business and Professions Code § 7159.10. Under this lane: payment is due at completion only (no deposit), and the 3-business-day cooling-off period below does not apply. Same- or next-day scheduling may be available subject to crew availability.

3. Scheduling, Cancellation, and the California 3-Day Cancellation Right

  • Appointments are confirmed via the customer's preferred channel (SMS, email, or phone).
  • Customers may reschedule or cancel by contacting us at least 24 hours before the scheduled appointment.
  • Same-day cancellation may result in a service fee at our discretion.
California 3-Business-Day Cancellation Right (B&P § 7159(d)(3)): For any residential home improvement contract over $500, you have the right to cancel the contract for any reason within three (3) business days after signing — or five (5) business days if you are 65 years of age or older — by sending us written notice. Work cannot begin until the cancellation period expires, unless you sign a separate written waiver for emergency or threat-to-property-or-health work. This right does not apply to Service and Repair Contracts under $750 (see § 2a) or to commercial / contractor-to-contractor work.

4. Equipment Access and Scope Changes

  • Most of our services require equipment access to the work area (e.g., excavator gate clearance). If access is not as described when we arrive, we may revise the quote or decline the job.
  • Scope changes discovered on-site will be discussed with the customer before continuing work. We will not perform additional work without your explicit approval.

5. SMS Communications

Text messages sent by Aloha Dirt Works are governed by our Privacy Policy. By providing your phone number, you consent to receive transactional and (where separately consented) promotional messages from us.

  • Message and data rates may apply.
  • Reply STOP to opt out at any time.

6. Warranties

We warrant our workmanship for a period reasonable to the type of work performed. Specific warranty terms vary by job type and will be discussed before work begins.

7. Liability

Our liability for any claim arising from our services is limited to the amount paid by the customer for the services in question. We are not liable for indirect, consequential, or incidental damages.

8. Disputes

Disputes are governed by the laws of the State of California. Customers and Aloha Dirt Works agree to first attempt good-faith resolution by direct communication before any legal action.

9. Changes to These Terms

We may update these terms occasionally. Continued use of our services after changes constitutes acceptance.

10. Mechanics Lien Rights and Preliminary 20-Day Notice

On all residential jobs, Aloha Dirt Works (SDPP, Inc.) serves a Preliminary 20-Day Notice as required and protected by California Civil Code §§ 8200 et seq. This is a standard statutory notice that preserves our mechanics lien rights. It is not a lien itself, and it does not affect your property unless we are not paid for work properly performed under a signed agreement. The notice informs you of your right to receive lien releases from subcontractors and material suppliers before final payment.

11. Workers' Compensation Insurance

SDPP, Inc. dba Aloha Dirt Works maintains workers' compensation insurance as required by California Labor Code § 3700. A current Certificate of Insurance is available upon request by emailing [email protected].

12. California Contractors State License Board (CSLB) Consumer Notice

California Business and Professions Code § 7030 (verbatim):

"Contractors are required by law to be licensed and regulated by the Contractors State License Board which has jurisdiction to investigate complaints against contractors if a complaint is filed within four years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractors State License Board, P.O. Box 26000, Sacramento, California 95826."
